Training Agenda

  • Session 1 – Investigation
    • Method: A review of the information required to determine the liability of  the insured and their insurers.
    • Objectives: To To understand the importance of establishing the facts of the matter, including root cause analysis and witness evidence, and consideration of subrrogation possibilities.
  • Session 2 – Liabiltiy Assessment
    • Method: Using case studies and group discussion to analyse whether the insured is liable to the claimant and whether insurers are liable to indemnify the insured.
    • Objectives:  To understand the general principles of how legal liability arises and the policy terms and conditions impacting insurers’ liability to meet the claim.
  • Session 3 – Case Management
    • Method: Case Studies and group discussion
    • Objectives: To analyse how liability claims are progressed, including advice on effective correspondence and negotiation.
  • Session 4 – Quantum and Settlement
    • Method: Review and group discussion
    • Objectives: To understand the settlement process, the role of loss adjusters and lawyers, conflicts of interest, and forms of discharge.
